By accessing or using the Habit Tuner mobile application and website at habittuner.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by Habit Tuner, Inc..

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

To access the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Habit Tuner offers paid subscription plans. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable subscription rate. Payments are processed by Stripe.

• Harmonized plan: $49.99/month

You may cancel your subscription at any time through the customer portal, accessible from your account page, which connects to the Stripe billing portal. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

Habit Tuner is an AI-powered health habit platform that generates personalized daily plans based on your health data. The Service includes workout planning, nutrition tracking, hydration monitoring, sleep analysis, and coaching features.

The Service is not medical advice. Habit Tuner does not diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare provider before starting any new exercise or nutrition program. You use the Service at your own risk.

The Service uses artificial intelligence to generate daily plans, workout recommendations, and coaching insights. AI-generated content is provided for informational purposes and should not be treated as professional medical, nutritional, or fitness advice. AI outputs may occasionally contain errors or inaccuracies.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including health data obtained through Apple HealthKit.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the Service
• Share your account credentials with others
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to access the Service (bots, scrapers, etc.)
• Circumvent any usage limits, rate limits, or access controls

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and the underlying AI models — are the exclusive property of Habit Tuner, Inc. and are protected by copyright, trademark, and other intellectual property laws.

To the maximum extent permitted by law, Habit Tuner, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
